St Albans Rooms – Terms and Conditions
Definitions
“You” Person or organisation who is hiring a room.
“Client(s)” Any person/people that You will be meeting in the room.
“Premises” The physical location of our rooms: 21 Victoria Street, St Albans AL1 3JJ.
“Room(s)” The room/space booked by You.
“We” St Albans Rooms.
“Service” Room hire provided by St Albans Rooms.
“Booking” Room reservation at the premises.
“Party” Refers to St Albans Rooms and/or You.
This is an agreement between Case & Tow Limited t/a St Albans Rooms, Registered Address: 4 Chene Mews, Waverley Road, St Albans Al3 5QF, Company no: 11688552, VAT no: 350701826 and You.
You agree that by Booking a Room You have read, understood and agree to these Terms and Conditions. Any variation to these Terms and Conditions shall have no effect unless expressly agreed in writing by St Albans Rooms.
Bookings/Payments
Before You make your first Booking You must provide St Albans Rooms with proof that You have the appropriate liability insurance, professional indemnity insurance and evidence of any professional body membership and qualifications relevant to your planned use of the Room. Counsellors and therapists must maintain the appropriate certification, qualifications and a Disclosure and Barring Service (DBS) check if working with vulnerable Clients.
Rooms are available for use between the hours of 08:00hrs-22:00hrs. If You require a Room at a specific time outside these hours there will be a further charge agreed with You, and St Albans Rooms will do all that is reasonable to comply with your request.
Bookings must be paid in advance.
All Room hire charges are fully inclusive.
Once a Booking has been made You will receive a confirmation email and a paid invoice.
The Room can only be used during the hours that have been booked.
If You do not use the booked Room for the full duration of the Booking no refunds will be given.
St Albans Rooms reserves the right to refuse or accept a Booking for any reason, or no reason.
Booking Amendments and Cancellation Policy
If You wish to amend your Booking (e.g. change the date or times of the Room hire) St Albans Rooms will use reasonable endeavours to comply with your request, however St Albans Rooms cannot guarantee that this request will be honoured. Changes may require further payment which St Albans Rooms shall agree with You at the time.
You can cancel a Booking anytime up to 48 hours before the time of the Booking for a full refund. Long term Bookings require one months written notice for cancellation.
St Albans Rooms do not currently include a buffer between different client bookings so it is imperative you vacate your room promptly. We will endeavour to make room change overs as quickly and safely as possible but during busy times when room change over time is limited, we ask clients to use the anti bacterial cloths provided, to wipe any hard services in the room (door handles, desk tops, remote control etc) at the end of the booking.
St Albans Rooms cannot be held responsible for any late running of previous bookings or damage/mess from previous clients which would cause the late start of your session.
St Albans Rooms will do everything possible to ensure your session is in the room you have booked for the exact time of the booking however we reserve the right to move your booking to another room and extend your session to meet the allocated time you have booked where necessary.
St Albans Rooms reserves the right to change the Room booked but will endeavour to contact You before doing so. All reasonable efforts will be made to ensure that any replacement Room will be as suitable as the original.
St Albans Rooms reserves the right to cancel Bookings for circumstances out of their control including, but not limited to, lockdowns and local restrictions as a result of epidemics and/or pandemics; government restriction; a power or hardware failure; a failure of a third party provider; fire and/or floods at or near the Premises; misconduct or negligence of a customer; delegate or external third party; or an act of God. A full refund will be given.
St Albans Rooms reserves the right to cancel Bookings for any reason, or no reason.
Access And Leaving The Premises And Room
Access to the Premises
On the day of the Booking You must arrive at the Premises at least ten minutes before the Booking time where a concierge will greet You at the door. You will then be either guided to the waiting area if the Room You have booked is still occupied, or directed to the Room if unoccupied.
St Albans Rooms’ team are not at the Premises to act as your receptionist or to provide any additional services to You.
Leaving the Premises
You must vacate the Room as soon as your pre-paid slot has finished. Other people/organisations may be using the Room after You and therefore running over the allocated time slot is not permitted.
Upon finishing the Booking, St Albans Rooms requests that You and your Client(s) leave the Premises as soon as possible, and that You guide your Client(s) to the exit before leaving yourself.
You must switch off all lights and electronic equipment when leaving the Room.
All property that You and your Client(s) bring into the Premises must be removed immediately at the end of the Booking.
Room Usage
You are responsible for ensuring that the Room is suitable and safe for the purpose for which it is intended to be used. You are responsible for all activities undertaken and will give reasonable consideration to other users of the Premises. Rooms should not be used for any purpose other than the purpose You have booked.
You and your Client(s) should conduct yourselves in a reasonable and respectful manner at all times whilst anywhere in the Premises. St Albans Rooms reserves the right to eject or exclude You and/or your Client(s) if We consider You and/or your Client(s) to be objectionable.
St Albans Rooms requires advance warning of any unusual activities taking place in the booked Room (for example playing music, singing, dancing, painting, etc.) to allow for appropriate authorisation and planning. St Albans Rooms reserves the right to refuse such activities from taking place should they be deemed to interfere with other people/organisations within, or outside the Premises.
Using the rooms for video and photography shoots is prohibited. Should you require professional photographs for marketing purposes please contact us. We are happy to provide credited professional stock photographs for this purpose.
No furniture may be moved in the Rooms without the permission of St Albans Rooms.
Internet Usage
St Albans Rooms will not accept responsibility for any virus following the use of the internet and We recommend that if utilising your own equipment that sufficient software protection is installed.
St Albans Rooms will endeavour to ensure uninterrupted access to the internet at all times; however, We cannot guarantee that access to the internet will be uninterrupted through either a component/hardware fault or by the service provider. During the hiring of the Rooms, You agree to use the wireless broadband internet facility in a responsible manner and not for illegal purposes or those which may cause offence. St Albans Rooms reserves the right to pass on any records to the authorities if requested to do so.
Smoking
No smoking is permitted in the Premises.
Illegal Activities
No illegal activities are permitted, including but not limited to drug abuse, gambling, violent or threatening behaviour.
Food and Drink
To maintain the standards on offer in the Rooms we request no food should be consumed in the Rooms. Any food brought into the Premises must be consumed in the kitchen. Non-alcoholic drinks are permitted. Tea and coffee can be made in the kitchen and consumed in the Room You have booked.
Fire Risk and Safety
You must observe the fire and safety information given when you arrive for your first Booking. No naked flames are allowed including, but not limited to, candles and incense sticks.
Animals
No animals are allowed in the Premises apart from assistance dogs, or by prior written consent of St Albans Rooms.
Equipment
You are allowed to use your own equipment in the Room for the Booking. It must be removed at the end of the Booking.
Incidents/Accidents/Damage/Breakage
You are responsible for the Room and its contents during your sessions. Any incident/accident/damage/breakage that occurs whilst on the Premises must be brought to St Albans Rooms’ attention immediately.
If any damage or breakages occur, St Albans Rooms reserves the right to make a reasonable charge for the repair or replacement of damaged or broken items. If any Room is damaged to the point that it is rendered unfit for use, You will be obliged to pay compensation to St Albans Rooms for the lost revenues whilst the Room is out of use plus the cost of repair and replacement at the current market value.
No items are to be affixed to the walls, floors or ceilings of any part of the Premises without the St Albans Rooms giving prior written consent.
The Room and Premises must be left in a safe, clean and tidy condition so that other people/organisations can use them immediately after You.
Indemnity/Damage/Liability/Qualifications/Insurance
Before You make your first Booking You must provide St Albans Rooms with proof that You have the appropriate liability insurance, professional indemnity insurance and evidence of any professional body membership and qualifications relevant to your planned use of the Room. Counsellors and therapists must maintain the appropriate certification, qualifications and a Disclosure and Barring Service (DBS) check if working with vulnerable Clients. This is to make sure that St Albans Rooms is fully protected against any loss, damage or other liability that We incur by providing You with the Service.
You are in charge of bringing your own equipment/property to the centre and any equipment/property left in the building is done so at your own risk.
You agree to accept full responsibility for and to indemnify St Albans Rooms against all claims made in respect of any accident, loss or damage to any equipment/property brought into the Premises by You and/or your Client(s) or any other person(s) invited by You, or not, who attends the building in connection with the Booking.
St Albans Rooms shall not be responsible for any loss due to lockdowns and local restrictions as a result of epidemics and/or pandemics; a power or hardware failure; government restriction; a failure of a third party provider; fire and/or floods at or near the Premises; misconduct or negligence of a customer; delegate or external third party; or an act of God or any other reason outside St Albans Rooms’ control which may cause the Premises to be temporarily closed or the Booking cancelled/interrupted.
You agree that St Albans Rooms shall not be liable, whether in contract, tort (including negligence) or otherwise for any indirect loss, however arising.
You agree to indemnify St Albans Rooms from any liability, loss or damage arising from your activities on the Premises.
Nothing in these Terms and Conditions shall exclude or restrict either Party’s liability in respect of death or personal injury resulting from its negligence, or for fraudulent misrepresentation.
There is no intention in these Terms and Conditions on the part of St Albans Rooms or You to create a partnership or tenancy of any sort.
General
Assignment
The Booking shall not be assignable by You, but may be assigned by St Albans Rooms.
Entire Agreement
These Terms and Conditions set out the entire agreement and understanding between You and St Albans Rooms and shall supersede and replace any discussions and all documentation previously issued by either Party in relation to its subject matter.
Notices
Any notice required under these Terms and Conditions shall be deemed to have been given if delivered by hand, sent by first class post or emailed to the Party concerned at the last known address, and deemed to have been received on the day of despatch if sent by hand or email, and on the third day after sending by post.
Ability Accept These Terms and Conditions
By making a Booking, You warrant that You are at least 18 years of age, and that there is no legal reason that You cannot accept these Terms and Conditions.
Waiver
No waiver by St Albans Rooms of any breach of these Terms and Conditions by You shall prevent the subsequent enforcement of these Terms and Conditions.
Validity
If at any time any one or more of these Terms and Conditions is held to be or becomes void, ineffective or unenforceable, it shall be omitted from these Terms and Conditions and the remainder of the Terms and Conditions shall remain in full force and effect.
Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with English Law and any claim or dispute shall be submitted to the English court.
